Guidelines for Foreign Employers Hiring Manpower from India


1. Partner Only with Licensed Recruitment Agencies
  • Ensure that the recruitment agency you engage is registered with the Ministry of External Affairs (MEA), Government of India, under the Emigration Act, 1983.
  • Ask for the Recruiting Agent (RA) License Number and verify it at: https://emigrate.gov.in
2. Sign a Formal Demand Letter & Power of Attorney
  • Provide a Demand Letter detailing:
    • Job categories
    • Number of workers
    • Salary and benefits
    • Contract durationn
    • Working conditions
  • Issue a Power of Attorney authorizing the Indian agency to act on your behalf.
3. Offer Transparent and Fair Employment Terms
  • Ensure the employment contract includes:
    • Monthly salary in local currency
    • Working hours and rest days
    • Free or subsidized accommodation and food (if applicable)
    • Medical facilities and insurance
    • End-of-service benefits or gratuity (if legally required)
4. Comply with Host Country Labour Laws
  • Employment conditions offered must align with host country labour laws, as well as the minimum standards required by Indian emigration authorities.
5. Get the Employment Contract Pre-Approved
  • The final employment contract must be pre-approved by the Indian Protector of Emigrants (POE) through the Indian recruitment agency.
  • All contracts are uploaded on the eMigrate portal for government oversight.
6. Avoid Charging Workers Recruitment Fees

All recruitment expenses-such as visa processing, air tickets, documentation, etc-must be borne entirely by the employer.

❗ Under no circumstances should a worker’s salary be deducted-whether directly or indirectly-to recover recruitment costs, joining ticket expenses, or visa-related charges.

Any such deductions are strictly prohibited and may result in blacklisting of the employer or cancellation of their recruitment approvals by the Government of India.

Employers are urged to sign ethical recruitment declarations and comply fully with zero-fee recruitment policies to uphold worker dignity, prevent exploitation, and promote long-term partnerships with Indian manpower stakeholders.
7. Participate in Orientation & Pre-Departure Briefings
  • Ensure that workers attend mandatory pre-departure orientation sessions organized by Indian agencies or government centers.
8. Facilitate Timely Visa & Travel Arrangements
  • Support the issuance of visas, travel tickets, and clearances required for timely mobilization of selected candidates.
9. Respect Worker Rights Post-Deployment
  • Provide a safe, respectful, and inclusive working environment.
  • Address grievances promptly, either directly or through the Indian Embassy/Consulate in your country.
10. Maintain Ongoing Communication
  • Stay in touch with the recruiting agency and Indian embassy officials to:
    • Address legal/employment issues
    • Coordinate future hiring needs
    • Ensure worker welfare
